RIGHT-OF-WAY EASEMENT

for a good and valuable consideration, the receipt of which is hereby acknowledged, does hereby grant unto DIXIE ELECTRIC POWER ASSOCIATION, a corporation whose post office address is Laurel, Mississippi, and to its successors and assigns, the right to enter on the lands of the undersigned, situated in the County of _____________, State of Mississippi, and more particularly described as follows:

    


in Section ________, Township __________, North, Range ___________ West, and to place, construct, operate, repair, maintain, relocate, and replace thereon and in or upon streets, roads, or highways abutting said lands, an electric transmission or distribution line or system, and to clear rights-of-way by any method deemed proper or desirable and permitted by law or regulations of trees and shrubbery to the extent necessary to keep them clear of said electric line or system and to cut down or otherwise remove from time to time all dead, weak, leaning, or dangerous trees that are tall enough to strike the wires in falling.  The minimum right-of-way widths shall be: ten (10) feet for insulated service and underground cable; twenty (20) feet for bare service wire; thirty (30) feet for single phase (1) primary wire; and forty (40) feet for multiphase (2or 3) primary wire. At poles where guy wires are required an additional easement area of ten (10) feet in width from the edge of the right-of-way to a point five (5) feet beyond the anchor location will be included in the easement area granted. The Association shall have the right to widen said right-of-way to such widths when upgrading electrical service.
 In granting this easement, it is understood that at pole locations, only a single pole and appurtenances will be used, and that the location of the poles will be such as to form the least possible interference to the property owner, provided it does not materially increase the cost of construction.
 The undersigned covenants that he is the owner of the above-described lands and that the said lands are free and clear of encumbrances and liens of whatsoever character except those held by the following parties:

 It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to read in the plural and that words used in the masculine gender shall be construed to read in the feminine.
